Bring Pets Home “Holiday Shopping” Sweepstakes
Official Rules

No purchase necessary. Purchase will not improve odds of winning. Open to legal residents of the United States and the District of Columbia, 18 years of age or older who are members of Bringpetshome.org at time of entry. Void in Puerto Rico and where prohibited.

1. Eligibility: The Bring Pets Home “Holiday Shopping” Sweepstakes (the “Sweepstakes”) is open to legal residents of the United States and the District of Columbia, who are physically located and reside in the US and DC, 18 years of age or older and who are current members of Bringpetshome.org or become a member of Bringpetshome.org at the time of entry ("Eligible Participant"). If you wish to become a member of Bringpetshome.org, you may sign up at http://www.bringpetshome.org/shop/register.aspx or you can create a Bring Pets Home account via Facebook Connect. Membership to bringpetshome.org is free. Void in Puerto Rico and where prohibited. Employees, directors and officers, and their immediate family members (spouse, parents, children, siblings, and their respective spouses), and their respective household members (whether related or not), of Bring Pets Home Foundation, Schering-Plough Corporation (the “Sponsor”), its parent company (if any), affiliates, subsidiaries, divisions, advertising and promotion agencies, and Strobe Promotions, Inc., are not eligible to enter. Sweepstakes is subject to all federal, state, and local laws. U.S. law governs this Sweepstakes.
2. Sweepstakes Timing: The Sweepstakes begins at 12:00:00 am Eastern Time (ET) on November 23, 2009 and ends 11:59:59 pm ET on January 31, 2010 (the “Promotion Period”). There will be a random drawing conducted at the end of the Promotion Period to award one (1) Grand Prize and one hundred (100) First Prizes.
3. How to Enter: There are two (2) ways to enter the Sweepstakes: (1) Automatic entry & (2) U.S. Mail. (1) Automatic Entry: (a) Consumers who are not currently members of Bringpetshome.org but wish to participate in the Sweepstakes may sign up to become a member at http://www.bringpetshome.org/shop/register.aspx or can create a Bring Pets Home account via Facebook Connect and receive (1) entry in the Sweepstakes. Limit one entry per person during the Promotion Period via this method of entry. (b) Eligible Participants will be automatically entered in the Sweepstakes each time they do the following: Log in at http://www.bringpetshome.org or via Facebook Connect, click on the “Shop to Help” link and make a qualified purchase at any participating online retailer during the Promotion Period. Eligible Participants will receive one entry for each qualified purchase they make during the Promotion Period. For these purposes, a “qualified purchase” is defined as any item or group of items bought at one time from any one of the participating retailers listed on the “Shop to Help” site. Multiple items purchased at the same time (during the same checkout process) from any one of the participating retailers listed on the “Shop to Help” site will be considered “one purchase” and thus “one entry”. (c) Eligible Participants will receive one (1) bonus entry when they identify a specific animal shelter they wish to support when they make a qualified purchase through the Shop to Help program during the Promotion Period. There is a limit of one (1) entry per person via this method of entry. All automatic entries must be received by 11:59:59 pm ET on January 31, 2010 in order to be eligible. (2) Alternate Method of Entry: To enter the Sweepstakes without making a qualified purchase, print your name, address, city, state, ZIP code, email address (optional) and daytime telephone number on a 3” X 5” piece of paper, insert entry into envelope, affix postage and mail to: Bring Pets Home “Shop to Help” Sweepstakes, PO Box 825, Bethpage, NY 11714-0825. Enter as often as you wish; limit one entry per outer mailing envelope. Email address included in the mail-in entry will only be used as a contact method for this Sweepstakes and will not be used for marketing purposes by anyone or shared with any third party. Mail-in entries must be postmarked by February 1, 2010 and received by February 8, 2010 in order to be eligible. Entries become the property of the Sponsor and will not be acknowledged or returned. Entries that have been generated by a script, macro, bot or any other automated means will be deemed void. Mechanically reproduced, copied, illegible, incomplete or inaccurate entries are void. Proof of mailing does not constitute proof of delivery. Entries become the property of the Sponsor and will not be acknowledged or returned.
4. Determination of Winners: One (1) Grand Prize winner and one hundred (100) First Prize winners will be selected in a random drawing on or about February 15, 2010 from among all eligible automatic and mail-in entries received. Random drawing will be conducted by Strobe Promotions, Inc., the independent judging organization, in Hicksville, NY. Potential Grand & First Prize winners will be notified via electronic mail and/or overnight or U.S. Mail and/or Facebook (depending upon log in method used to enter the Sweepstakes) on or about February 15, 2010. Potential First Prize winners may be required to verify their mailing address prior to issuance of prize. Potential Grand Prize winner will be required to sign an affidavit of eligibility/liability release and where legal, publicity release and a federal and state tax release, and return these documents, properly executed, within seven (7) days of issuance of notification. Non-compliance with this time frame, or if prize or prize notification is returned as undeliverable, will result in the entrant being disqualified, and a potential alternate winner will be selected. Odds of winning a prize depend upon the total number of eligible entries received during the Promotion Period. All prizes will be awarded. If potential Grand Prize winner is deemed a minor in his/her state of residence, prize will be awarded in the name of the parent/legal guardian.
5. Prizes: One (1) Grand Prize: $5,000 cash to be awarded in the form of a check to the winner. In addition, a $5,000 donation will be awarded to the Bring Pets Home shelter of the winner’s choice. Animal Shelter selected must be designated as a non-profit organization under Sec. 501 (c)(3) of the Internal Revenue Code in order to be eligible to receive the donation. If for any reason, a Bring Pets Home shelter designated by the winner does not qualify at time prize is awarded, Sponsor reserves the right, in its sole discretion, to donate the $5,000 to a qualifying Bring Pets Home animal shelter. Approx. Retail Value (ARV): $10,000. One Hundred (100) First Prizes: The Ultimate Pet ID ARV: $20/ea. Total ARV of all prizes: $12,000. Prize is not transferable, except at the Sponsor’s sole discretion. No substitutions or cash equivalents are permitted, except by the Sponsor at its sole discretion. Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value if advertised prize is unavailable. All taxes and any other costs related to this prize not specifically stated within these Official Rules are the sole responsibility of winners. Limit one prize per person. Any and all guarantees and warrantees of merchandise prize are subject to the manufacturer’s terms and conditions, and winners agree to look solely to said manufacturers for any such warranty or guarantee claim.
6. Conditions of Participation: By entering, entrants agree to be bound by these Official Rules including all eligibility requirements. By accepting a prize, winners consent to the use of their names, images, likenesses, photographs, voices, and biographical materials for advertising, publicity, and promotional purposes by Sponsor, or a party designated by the Sponsor, including but not limited to, any online announcements, without additional compensation, except where prohibited by law. Entrants agree that the conditions of submission set forth in these Official Rules, and all documents and agreements incorporated in these Official Rules by reference solely govern the relationship between the entrant and Sponsor in connection with this Sweepstakes. Entrants agree that any and all disputes shall be governed by the laws of the state of New Jersey.
7. Limitation of Liability: ENTRANTS HEREBY AGREE TO RELEASE, INDEMNIFY AND HOLD HARMLESS BRING PETS HOME FOUNDATION, SCHERING-PLOUGH CORPORATION (“SPONSOR”), AND THEIR RESPECTIVE PARENT COMPANY, AFFILIATES, SUBSIDIARIES, DIVISIONS, STROBE PROMOTIONS, INC., ADVERTISING AND PROMOTION AGENCIES, AND THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS AND SHAREHOLDERS (COLLECTIVELY, THE “RELEASEES”) FROM ANY CLAIMS, ACTIONS, INJURY, LOSS OR DAMAGE OF ANY KIND, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY OR DEATH, RESULTING FROM PARTICIPATING IN THIS SWEEPSTAKES OR FROM THE ACCEPTANCE, POSSESSION, OR USE OR MISUSE OF ANY PRIZE AWARDED OR PARTICIPATION IN ANY PRIZE-RELATED ACTIVITY. THIS LIMITATION OF LIABILITY IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OF DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES. PARTICIPANTS AGREE THAT SPONSOR HAS NOT MADE NOR IS IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, STATUTORY, EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE), IN FACT OR IN LAW, RELATIVE TO THE SWEEPSTAKES. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING SPONSOR, DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO THE BRING PETS HOME SITE AND SPONSOR SHALL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS RELATED THERETO. Releasers are not responsible for lost, late, illegible, damaged, postage due or stolen entries or submissions, or problems of any kind, whether mechanical, human or electronic. Releasees are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, inability to access a website or complete a qualifying purchase or registration, fraud, incomplete, garbled, or delayed computer transmissions or inaccurate transcription of entry information, whether caused by the Sponsor, users or by any of the equipment or programming associated with or utilized in this promotion or by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit a participant’s ability to participate in the promotion. Entry materials that have been tampered with or altered are void. Sponsor reserves the right, in its sole discretion, to cancel or suspend part or all of this Sweepstakes at any time without notice, if in the judges’ opinion there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or integrity and proper play of the Sweepstakes. In such event, Sponsor may void any entries they suspect are at issue and award prizes from among all eligible entries received up to the date of cancellation. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE WEBSITE OR ANY ONLINE SERVICE RELATED TO THIS PROMOTION OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. Sponsor reserves the right to disqualify entrants who violate the rules or interfere with this Sweepstakes in any manner. If an entrant is disqualified, Sponsor reserves the right to terminate that entrant’s eligibility to participate in the Sweepstakes. Any attempts by an individual to access any website associated with this competition via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible. Use of automated entry devices or programs is prohibited.
8. Winners’ List: For the names of winners, available after March 1, 2010, mail a self-addressed, stamped envelope by March 1, 2010, to: The Bring Pets Home “Holiday Shopping” Sweepstakes, P.O. Box 913, Bethpage, NY 11714-0913.
9. Sponsor & Administrator: The sole Sponsor of this Sweepstakes is Schering-Plough, 2000 Galloping Hill Road, Kenilworth, N.J. 07033-0530. Administrator: Strobe Promotions, Inc., 535 S. Broadway, Suite 203, Hicksville, NY 11801.
